Terms of Service

Last Updated: March 10, 2026

Welcome to iQuipé Cloud. These Terms of Service ("Terms") govern your access to and use of our cloud infrastructure services, APIs, and website (collectively, the "Services"). Please read these Terms carefully before using our Services.

By registering for an account or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Account Registration and Security

To use the Services, you must create an account. You represent and warrant that all information you provide during registration is accurate, current, and complete.

2. Acceptable Use Policy (AUP)

You agree not to use the Services in any way that violates any applicable local, national, or international law or regulation. Specifically, you agree not to use the Services to:

Violation of the Acceptable Use Policy may result in the immediate suspension or termination of your account without notice or refund.

3. Billing, Payments, and Refunds

Our Services are billed on a utility ("pay-as-you-go") basis. By adding a payment method, you authorize us to charge you for all resources provisioned under your account.

4. Service Level Agreement (SLA)

We strive to ensure high availability of our infrastructure. iQuipé Cloud provides a 99.9% Monthly Uptime Guarantee for Compute Instances and Object Storage.

If we fail to meet this SLA, you may be eligible for service credits applied to future invoices. Scheduled maintenance windows, which will be announced at least 48 hours in advance, do not count against the SLA uptime calculations.

5. Data Privacy and Security

Your privacy is important to us. Our collection and use of your personal data are governed by our Privacy Policy.

While we implement industry-standard security measures to protect the underlying physical infrastructure, you are solely responsible for the security of your own data. This includes managing OS-level firewalls, keeping software updated, and maintaining adequate backups of your data. iQuipé Cloud is not liable for data loss resulting from user misconfiguration or compromised account credentials.

6. Termination and Suspension

You may terminate your account at any time by deleting all active resources and closing your account via the billing dashboard.

iQuipé Cloud reserves the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease, and any remaining data on our servers will be permanently deleted.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall iQuipé Cloud, its affiliates, directors, or employees be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Services.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
